ԱՇԽԱՏԱՆՔԻ ՆԿԱՐԱԳԻՐ
: 
The USAID/Armenia Project will field a National Expert for Developing Internal Court Administration Documentation (pursuant to this Scope of Work), who in cooperation with JSSP staff duly designated by the Chief of Party of the Project, will support, and advise on adopting/ ratifying the Statute of the Staff of the Constitutional Court. Based on the revised and adopted Statute and following the final approval and adoption of the revised court business process, the National Expert shall also develop the “position passports” (job descriptions) for all the Court’s staff members, the terms and conditions of which shall be defined by another agreement.
The estimated period of assignment is from October 16, 2023, to December 31, 2023. All work will be performed in Yerevan in person and/or remotely, with the possibility of out-of-town travel for any Court staff workshops/ retreats. The Project will make all administrative arrangements related to the assignment to ensure that the National Expert meets relevant counterparts as needed. The meetings and events with the representatives of the Constitutional Court necessary for the implementation of the assignment shall be coordinated and arranged by the Project.
The assignment under this SOW shall be undertaken individually by the selected National Expert, who shall report to the Chief of Party and the Deputy Chief of Party, and work in strong collaboration with the designated personnel of the Project, namely the Court Administration Advisor - Objective Lead 1. The latter will coordinate and oversee the implementation of day-to-day assignments, participate in related work meetings and discussions, review, and provide initial comments on drafts of the national expert’s deliverables. The final confirmation of the acceptability of the content of all the deliverables defined by this SOW, as well as the authorization of disbursement of the payment, shall be undertaken by the Chief of Party.
ՊԱՐՏԱԿԱՆՈւԹՅՈւՆՆԵՐ

The National Expert shall perform the following tasks:
- Review and assess existing legislation as well as the draft Statute of the Court and related documents, including but not limited to the organizational structure, chain of command, reporting lines;
- Advance any current implemented efforts and finalize drafting of the text of the Statute of the Staff of the Constitutional Court in accordance with all relevant legal requirements, and/ or draft a new version of the statute text based upon the necessity, and in consultation with the Court and the USAID Project;
- Work closely with the relevant national authorities and/or Constitutional Court stakeholders (such as the Chief of Staff, Legal-Advisory Department, HR Division) in accordance with the pre-agreed modality with the Project and the Constitutional Court to ensure the accuracy and completeness of the proposed Statute of the Constitutional Court, and their adherence to the relevant domestic legislation in force;
- Participate in the discussion(s) of the draft Statute with the Constitutional Court and revise the draft Statute based on the results of the discussion(s).
DELIVERABLES
The National Expert for Developing Internal Court Administration Documentation shall develop the following deliverables:
- A finalized draft version of the Statute of the Staff of the Constitutional Court, ready for the approval and ratification by the Justices of the Constitutional Court;
- Power Point or other thematic presentations related to the draft statute, and participation in any other discussions with the Court leadership as necessary.
The Level of Effort for the National Expert for all activities is 25 working days. The National Expert, therefore, is required to make all necessary organizational and administrative arrangements for his/ her working plan in a way that allows the achievement of all deliverables within the set time frame.
ԱՆՀՐԱԺԵՇՏ ՈՐԱԿԱՎՈՐՈՒՄՆԵՐ
: 
The National Expert is expected to possess the following qualifications and expertise:
- At least 5 years of proven relevant working experience in developing legal acts under civil service, preferably within the Governmental agencies of the Republic of Armenia, legal, law enforcement and/or court system context;
- Master's degree in Law, Business Administration, Human Resources, or a related field (master’s degree required);
- Familiarity with the structure and functioning of the judiciary in the Republic of Armenia, desirably with knowledge in respect to the Constitutional Court and/or similar governmental agencies and familiarity with labor laws, regulations, and compliance requirements existing in Armenia;
- Ability to collaborate effectively with diverse national stakeholders (such as the Civil Service Office) and incorporate their input in the working plans and deliverables;
- Collaborative and proactive approach to working with cross-functional team in combination with strong analytical and communication skills;
- Previous track of successful cooperation with international development agencies is preferred.

ԾՐԱԳՐԻ ՄԱՍԻՆ

The over-all purpose of the USAID/Armenia’s Justice Sector Support Project (hereinafter referred to as the JSSP or the Project) is to support the Government of Armenia in establishing a fair and equitable justice system and increase public confidence in the rule of law. JSSP supports targeted justice sector institutions through: (1) establishing effective and efficient court administration and case management systems; (2) supporting self-regulatory institutional capacity development; (3) improving legal and professional education; and (4) facilitating oversight of the implementation of justice sector reform through collaborative action.
Within the framework of the cooperation between the USAID/Armenia Project and the Constitutional Court of the Republic of Armenia (hereinafter referred to as the Court), the Project intends to provide assistance to the Court in the form of national expertise aimed at providing any necessary development, drafting, finalizing, and eventually facilitating ratifying the Statute of the Staff of the Court (hereinafter the Staff Statute). The existence and implementation of the Statute is a mandatory requirement under the Law on the Public Service of Armenia, under which the Court’s personnel transitioned in early 2020. Additionally, the required job descriptions under the civil service are not prepared and utilized at the Court, therefore the Project will also provide national expertise in developing the “position passports” (job descriptions), which will precisely provide clear description of tasks per department and individual staffer, enhancing the efficiency of the Court’s departments. The process of preparation of both the Statute and the job descriptions of the Staff shall be coordinated with the Court in line with the terms and conditions agreed with the Court and the project during the assignment.
