ОПИСАНИЕ ДОЛЖНОСТИ : 

The primary objectives of the assignment are to: (1) facilitate workshops for judges and SJC leadership to ascertain how the proposed legislation will impact judges; and (2) propose changes to the draft legislation that will make the evaluation process more objective and transparent while taking into consideration judges’ opinions on the matter.
This position reports to the Deputy Chief of Party. The designated Activity Lead will serve as primary point of contact.
The proposed level of effort for this assignment is up to 15 consultant/days. The authorized work week is five days per week and eight hours per day. The estimated period of assignment is from May 1 to May 30, 2024.

ОБЯЗАННОСТИ : 

In furtherance of this assignment, the Consultant will:
- Based on collected and analyzed data, produce a brief (together with JSSP MEL Specialist) that: (1) summarizes both quantitative and qualitative inputs and (2) makes specific recommendations for the judicial performance draft methodology revision and legislative reform;
- Facilitate workshops conducted by JSSP to present findings from an anonymous questionnaire completed by all judges in advance, identify points of contention, facilitate small group discussion, and gather opinions and discussion outcomes from workshop participants;
- Based on the anonymous survey results, workshop discussions, JSSP's Assessment on Performance Evaluation of Judges (2023), and international best practices, draft a set of recommendations to be shared with SJC leadership;
- Assist the SJC to make evidence-based, data-driven revisions to the proposed draft legislation.

DELIVERABLES
Specific deliverables are outlined below. These are subjects to be amended by USAID and/or the JSSP team during the assignment.
1. Set of recommendations to SJC to make evidence-based, data-driven revisions to the performance draft methodology and proposed draft legislation.
2. Final legislation package.

ТРЕБУЕМАЯ КВАЛИФИКАЦИЯ :

Language:
- Fluency in Armenian;
- Strong English language skills (written and spoken).

Education:
- Master’s degree in Law (Ph.D is preferred).

Experience:
- Minimum 5 years of experience in judicial reform or justice sector development (preferred);
- Familiarity with the structure and functioning of the judiciary in the Republic of Armenia, and very good knowledge of related legal frameworks in force currently;
- Experience with legal research and drafting (required);
- Familiarity with international best practices in judicial performance evaluation (preferred).

Other:
- Strong analytical and problem-solving skills;
- Ability to work independently;
- Strong writing and editing skills.

О ПРОГРАММЕ : 

The USAID Project on Justice Sector Support in Armenia (JSSP) supports the Government of Armenia to establish a fair and equitable justice system and increase public confidence in the rule of law. JSSP works with multiple justice sector institutions to: (1) establish effective and efficient court administration and case management systems; (2) support self-regulatory institutional capacity development for judicial institutions; (3) improve legal and professional education; and (4) facilitate implementation of justice sector reform through collaborative action.

USAID’s Integrity Systems and Rule of Law Assessment (July 2019) revealed gaps in SJC procedures and capacity to conduct fair judicial candidate selection, performance evaluation, and discipline. Addressing these and other shortcomings is critical to reducing flashpoints for corrupt practice, fostering greater accountability, and instilling greater public confidence. Objective 2 aims to ensure fair judicial candidate selection, performance evaluation, and discipline, as well as build the capacity for the judiciary’s effective internal (judicial actors) and external (public) communications. Accordingly, and on parallel tracks, JSSP will work hand in hand with the SJC to (1) improve processes for testing, selecting, and evaluating judges, and (2) design and implement a strategic communications plan for the SJC that validates and addresses public concern.

SJC is in the process of proposing legislation that will alter the methodology for judicial performance evaluation. The legislation has been drafted and SJC has expressed an interest in soliciting feedback from all judges and to take this into account before submitting the final draft legislative package to the National Assembly for ratification. JSSP appreciates that SJC would like to offer an opportunity for all judges to weigh in on the proposed legislation, recognizing that all judges and judge candidates will be impacted by these changes. To address the problems and challenges related to the existing gaps in the field of judges' performance evaluation, JSSP will present its assessment findings and recommendations to SJC leadership. The SJC in turn, and with JSSP’s assistance, will (1) engage interested stakeholders in reviewing and validating JSSP’s findings and (2) incorporate appropriate recommendations into the proposed legislation.
