ОПИСАНИЕ ДОЛЖНОСТИ : 

The primary objectives of the assignment are a) to investigate the root causes for the Arbitration and Mediation Center of Armenia underutilization; and b) propose targeted recommendations for strengthening its legal framework, policies, and referring bodies, paying attention to women access to ADR mechanism. The Consultant will develop gender gap assessment relating to access to ADR mechanisms and a report on how to enhance use of the Arbitration & Mediation Center.

Specific deliverables are outlined below. These are subjects to be amended by USAID and/or the JSSP team during the assignment.

1. Assessment report detailing the issues impeding the operations of the Arbitration & Mediation Center, along with proposed solutions, aimed at enhancing the effectiveness of its activities.
2. Presentation and other materials developed for the showcase event.

This position reports to the Deputy Chief of Party. The designated Activity Lead will serve as primary point of contact. The proposed level of effort for this assignment is up to 20 consultant/days. The authorized work week is five days per week and eight hours per day. The estimated period of assignment is from June 3 to July 3, 2024. The place of performance is Yerevan, Armenia (at the JSSP Office and/or at the GOAM agencies) and the remainder of the time will be spent remotely.

ОБЯЗАННОСТИ : 

In furtherance of this assignment, the Consultant will:
- Review and analyze relevant laws and regulations and any other documents necessary for understanding necessity of enhancing Arbitration & Mediation Center’s activities, problems and gender gaps in accessing existing and newly introduced ADR mechanisms;
- Engage (through oral interviews and written communication) with Center’s leadership, Staff and legal advisors to gather insights and understand Center’s vision of enhancing their activities;
- When necessary, conduct interviews and consultations with interested parties such as lawyers and legal experts;
- Draft gender gap assessment related to the access to ADR mechanisms;
- Draft a report on enhancing the usage of the Arbitration & Mediation Center;
- Develop presentation and other materials.

ТРЕБУЕМАЯ КВАЛИФИКАЦИЯ :

Language:
- Level 3 English (good working knowledge) and native fluency in Armenian,

Education:
- Master’s degree in law (Ph.D is preferred);
- Training programs in alternative dispute resolution are an advantage.

Experience:
- Minimum 5 years of experience in judicial reform or justice sector development (preferably in alternative dispute resolution);
- Familiarity with the structure and functioning of the judiciary and ADR mechanism in the Republic of Armenia, and strong knowledge of related legal frameworks in force currently;
- Experience with the legal research and drafting (required);
- Familiarity with the structure and functioning of the Armenian judiciary;
- Knowledge of the RA Civil Procedure Code, RA Law on Commercial Arbitration, RA Law on Mediation and other related legal acts;
- Ability to collaborate effectively with diverse national stakeholders (such as the Arbitration & Mediation Center, Ministry of Justice of RA) and incorporate their input in the working plans and deliverables;
- Previous track of successful cooperation with international development agencies (USAID, Council of Europe, UNDP, European Union (preferred).

Other:
- Strong analytical and problem-solving skills;
- Collaborative and proactive approach to working with cross-functional team in combination with strong analytical and communication skills;
- Ability to work independently;
- Strong writing and editing skills.

О ПРОГРАММЕ : 

The USAID Project on Justice Sector Support in Armenia (JSSP) supports the Government of Armenia to establish a fair and equitable justice system and increase public confidence in the rule of law. JSSP works with multiple justice sector institutions to: (1) establish effective and efficient court administration and case management systems; (2) support self-regulatory institutional capacity development for judicial institutions; (3) improve legal and professional education; and (4) facilitate implementation of justice sector reform through collaborative action.

As USAID’s 2019 Gender Analysis indicates, despite having equal socio-economic rights by law, women often are not able to exercise these rights due to factors including but not limited to discriminatory practices in the workplace; discriminatory property registration practices; patrilocal marriages and inheritance practices; limited access to resources; limited knowledge regarding their ownership rights over land, housing and other assets; and discrimination in accessing credit, especially in rural areas. Solutions to many of these issues can fall within the realm of ADR. Accordingly, the Project will assess gender gaps in accessing existing and newly introduced ADR mechanisms, with special attention to ensuring that these mechanisms benefit women of different ages, especially those living in rural areas, in an equitable manner.

The Arbitration and Mediation Center of Armenia advertises in-person and virtual hearings addressing a wide range of disputes in three languages. Yet, the Center remains underutilized, possibly due to a lack of public awareness, poor referral pathways, an unwillingness of lawyers to refer cases to the center, and/or general lack of public trust. JSSP will conduct a limited study to investigate the root causes for the Center’s underutilization and propose recommendations for strengthening its legal framework, policies, and referring bodies.
